TEACHER TRAINING TERMS AND CONDITIONS
1. Each Teacher Training Enrollment is for one person only and is non-transferable.
2. Credit card is billed once for the full amount listed above unless Participant has applied for and been approved for a payment plan. Payment plans require approval by Namaste Fitness Management and the establishment of a recurring automatic payment plan. Payment plans require a credit card on file. Teacher Training can be paid in full with cash or check, in addition to credit card.
3. Each Teacher Training Enrollment requires a non-refundable deposit of 20% of the total purchase price at the time of registration. If a Participant wishes to cancel their enrollment and request a refund, they must submit their request in writing by sending an email to service@namastefitness.com. All refund requests will be reviewed and approved according to the following schedule: date of request is greater than 90 days from the start date of training, 80% of the total purchase price will be refunded; date of request is 90 days or less and greater than 45 days from the start date of training, 50% of the total purchase price will be refunded; date of request is 45 days or less and greater than the start date of training, 25% of the total purchase price will be refunded; date of request is on or after the start date of training, no amount will be refunded. No refunds or partial refunds will be given once training has begun, regardless of circumstances. If Participant cancels enrollment and requests a refund while on a payment plan, the refund amount due as outlined on the schedule above will be forgiven from the outstanding balance due, however any remaining unpaid balance not yet received by Namaste Fitness will become immediately due. Failure to pay remaining unpaid balance immediately will result in a default of this agreement.
4. Payment Plans are subject to a service fee equal to 5% of the Remaining Balance Due. The total service fee will be calculated and added to the Remaining Balance Due. The sum will then be divided by the planned Number of Periodic Payments to determine the amount due at each periodic payment. Payment Plan can be prepaid at any time, however the sum of all remaining periodic payment amounts must be paid in full, including any remaining service fees.
5. Any failed payments will be assessed a Declined Payment Fee of $25. This includes, but is not limited to, failed payments caused by insufficient funds or expired cards. Participant and Cardholder will be required to pay both the past due periodic payment amount and any assessed fees within 14 days of failed payment or will be found in default of this agreement.
6. If for any reason the Participant should not oblige to any section or portion of this Agreement, the Participant shall be considered in default. Under such an event, the remaining balance of the Amount Owed shall be due within five (5) business days with the Participant and Cardholder liable to pay all reasonable attorneyโs fees and costs of collection of Namaste Fitness, Inc. In addition, Namaste Fitness, Inc. may reclaim any property or goods in connection with the Amount Owed, hold and dispose of the same, and collect expenses, together with any deficiency due from the Participant, subject to the Participantsโ right to redeem said items pursuant to law.
7. This Agreement shall be governed by, and construed in accordance with, the laws of the State of California.
8. Severability. The unenforceability or invalidity of any clause in this Agreement shall not have an impact on the enforceability or validity of any other clause. Any unenforceable or invalid clause shall be regarded as removed from this Agreement to the extent of its unenforceability and invalidity. Therefore, this Agreement shall be interpreted and enforced as if it did not contain the said clause to the extent of its unenforceability and invalidity.
